Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the BikeTouri mobile application ("App") operated by BikeTouri, Svenja Schrade ("we", "us", "our").
By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
2. Eligibility
You must be at least 16 years old to use the App. By using the App, you confirm that you meet this age requirement.
3. Account Registration
3.1 Account Creation
You may create an account using:
- Email and password
- Google Sign-In
- Apple Sign-In
You are responsible for maintaining the security of your account credentials. You must not share your account with others.
3.2 Account Accuracy
You agree to provide accurate information when creating your account and to keep it up to date. We reserve the right to suspend accounts with misleading or false information.
3.3 Account Deletion
You may request deletion of your account at any time. Upon deletion, your personal data and contributions will be removed in accordance with our Privacy Policy.
4. Using the App
4.1 Permitted Use
The App is designed to help bicycle travelers discover camping spots, services, amenities, and routes. You agree to use the App only for its intended purpose and in compliance with applicable laws.
4.2 Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent place information
- Post offensive, harmful, defamatory, or illegal content
- Upload photos that you do not have the right to share, or that contain inappropriate content
- Harass, threaten, or abuse other users
- Attempt to access other users' accounts or private data
- Use the App for commercial purposes (e.g., advertising, solicitation) without our permission
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the App
- Use automated tools (bots, scrapers, crawlers, harvesters) to access the App, API, or data
- Circumvent security measures or access controls
4.3 AI-Assisted Features
The App includes an AI-assisted support chat powered by third-party AI services (Anthropic). Messages you send to the support chat may be processed by these AI services to generate responses.
You should be aware that:
- AI-generated responses are provided for informational purposes and may not always be accurate or complete
- You should not share sensitive personal information (such as passwords or payment details) in the support chat beyond what is necessary to resolve your inquiry
- We may review support chat conversations to improve the quality of our service
- AI-processed data is handled in accordance with our Privacy Policy and the data processing agreements we maintain with our AI service providers
4.4 Content Moderation
We reserve the right to review, edit, or remove any user-generated content that violates these Terms or our community standards, without prior notice.
5. User-Generated Content
5.1 Your Content
You retain ownership of the content you submit (places, reviews, photos, comments). However, by submitting content to the App, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your content within the App and related services (such as the BikeTouri website).
This license is necessary to operate the App — for example, to display your reviews to other users, show your photos on place pages, and include your contributions in the community feed.
5.2 Content Responsibility
You are solely responsible for the content you submit. You represent that:
- You have the right to share the content
- The content is accurate to the best of your knowledge
- The content does not infringe on any third party's rights
- The content complies with applicable laws
5.3 Content Removal
You may delete your own reviews, photos, and comments through the App. Deleted content may remain briefly in backups before permanent removal.
We may remove content that violates these Terms or that we receive valid complaints about.
5.4 Place Submissions
Places you submit go through a review process before becoming publicly visible. We reserve the right to approve, reject, or modify submissions to ensure quality and accuracy.
6. Subscriptions and Payments
6.1 Supporter Subscriptions
The App offers optional yearly Supporter subscriptions at various price tiers. Subscriptions provide access to premium features.
6.2 Billing
Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. Payment terms, billing cycles, and refund policies are governed by the respective store's terms.
6.3 Auto-Renewal
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's App Store or Google Play settings.
6.4 Refunds
Refunds are handled by Apple or Google according to their respective refund policies. We do not process payments or refunds directly.
6.5 Price Changes
We may change subscription prices. Existing subscribers will be notified before any price increase takes effect. Price changes will apply to the next renewal period.
7. Intellectual Property
7.1 Our Rights
The App, including its design, code, graphics, logos, and original content (such as magazine articles), is owned by BikeTouri and protected by copyright and other intellectual property laws.
7.2 Open Data
BikeTouri uses open data from OpenStreetMap, which remains available under its respective open-data license. We provide attribution in the App and comply with applicable open-data license obligations.
Where an open-data license requires access to an OpenStreetMap-derived derivative database, you may contact us at hello@biketouri.com. This does not grant permission to scrape, crawl, harvest, or use automated tools against the App, API, or service.
7.3 Restrictions
You may not copy, modify, distribute, or create derivative works based on the App or its content, except as expressly permitted by these Terms or applicable law.
BikeTouri adds its own curation, enrichment, categorization, verification, app-specific metadata, and user contributions. These BikeTouri-specific elements, as well as the App, API, design, and service, are protected and may not be scraped, copied, bulk exported, mirrored, resold, redistributed, or used to build a competing service without our written permission.
Unauthorized scraping or bulk extraction may result in suspension, blocking of access, and legal action.
8. Disclaimers
8.1 Place Information
Place information in the App is sourced from a combination of public data, third-party sources, and community contributions. While we strive for accuracy, we do not guarantee that place information (including locations, amenities, pricing, opening hours, or availability) is accurate, complete, or up to date.
You are responsible for verifying place information before relying on it, especially for safety-critical decisions such as overnight stays, water sources, or route conditions.
8.2 No Travel Advisory
The App is an informational tool, not a travel advisory service. We do not guarantee the safety, legality, or suitability of any place or route listed in the App. Always exercise your own judgment and follow local laws and regulations.
8.3 Service Availability
We aim to keep the App available and functional, but we do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
8.4 Offline Functionality
Certain features require an internet connection. Offline maps and cached data may not reflect the most current information.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- We are not liable for any loss or damage resulting from reliance on place information, route data, or other content in the App
- We are not liable for actions of other users or third parties
- Our total liability for any claims related to the App shall not exceed the amount you paid us in the 12 months preceding the claim
Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the App
- Content you submit
- Your violation of these Terms
- Your violation of any third party's rights
11. Third-Party Services
The App integrates with third-party services including map providers, payment platforms, authentication providers, and AI services (such as Anthropic for support chat). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
12. Termination
12.1 By You
You may stop using the App and delete your account at any time.
12.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or abusive behavior
- Create risk or legal exposure for us
We will make reasonable efforts to notify you before termination, except in cases of serious violations.
12.3 Effect of Termination
Upon termination, your right to use the App ceases. Sections that by their nature should survive (such as Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will continue to apply.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions.
13.2 Jurisdiction
Any disputes arising from these Terms shall be subject to the courts having jurisdiction under applicable law, unless mandatory consumer protection laws provide otherwise.
13.3 EU Online Dispute Resolution
If you are a consumer in the EU, you may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution but will consider it on a case-by-case basis.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Displaying a notice in the App
- Updating the "Last updated" date at the top
Continued use of the App after changes constitutes acceptance. If you disagree with updated Terms, you should stop using the App and delete your account.
15. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and BikeTouri regarding use of the App.
- Severability: If any provision is found to be unenforceable, the remaining provisions remain in effect.
- No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment: We may assign our rights under these Terms. You may not assign yours without our written consent.
